Acceptance of Terms

Please read these Terms of Use (“Terms”) carefully before using the SHPE NJIT mobile application or website (the “Service”).

By accessing or using the Service, you agree to be bound by these Terms and to comply with applicable NJIT policies, university regulations, and laws. If you do not agree to these Terms, you may not access or use the Service.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

Organizational Status & Independence

The Service is operated by the Society of Hispanic Professional Engineers – New Jersey Institute of Technology Chapter (SHPE NJIT), a recognized student organization at the New Jersey Institute of Technology.

The Service is not an official product of NJIT, and SHPE NJIT does not act as an agent, representative, or contractual authority of NJIT. Official recognition by NJIT does not authorize SHPE NJIT to act on NJIT’s behalf or to create obligations in NJIT’s name.

Use of “SHPE” in the Service name is for descriptive community reference and does not imply endorsement by SHPE National.

The Service is also not operated by or on behalf of SHPE National, unless explicitly stated in writing.

Purpose of the Service

The Service exists solely to support SHPE NJIT’s educational, professional, and community-building mission. It is intended to facilitate member engagement, event coordination, internal communication, and organizational operations.

The Service is non-commercial in nature and provided for informational and organizational purposes only.

Our Role in Events

Events displayed, promoted, or managed through the Service are organized by SHPE NJIT officers, members, or approved collaborators. The Service provides technological and organizational tools only.

SHPE NJIT is not responsible or liable for:

• Event cancellations, rescheduling, or changes
• Inaccurate or outdated event information
• Actions or conduct of attendees, members, alumni, professionals, or third parties
• Off-campus activities or incidents; off-campus participation is at your own risk

Participation in events is voluntary and at your own discretion.

Eligibility & Membership

Certain features of the Service may be limited to NJIT undergraduate students, alumni, professionals, or other approved users.

Use of the Service does not guarantee membership, voting rights, leadership eligibility, or access to any specific event. Membership status and eligibility are determined solely by SHPE NJIT in accordance with its Constitution and NJIT policies.

Age Requirement

The Service is intended for college students, alumni, and professionals. If you are under 13, you may not use the Service.

User Conduct

You agree to use the Service in a lawful, respectful, and responsible manner. Use of the Service is subject to NJIT’s Code of Student Conduct, Title IX policies, anti-discrimination policies, and applicable federal and state laws.

The Service includes community and social features, including posts, comments, likes, and user interactions. You acknowledge that SHPE NJIT may moderate content, respond to reports, and take action to maintain a safe and respectful environment.

You must not:

• Harass, discriminate against, or abuse others
• Impersonate another person or misrepresent affiliation
• Misuse event systems, QR check-ins, or engagement features
• Upload unlawful, misleading, or inappropriate content
• Attempt to disrupt, exploit, or gain unauthorized access to the Service

User-Generated Content

The Service may allow you to upload or submit content such as photos, text, feedback, or profile information (“Content”).

You are solely responsible for any Content you submit and represent that you have the right to do so. By submitting Content, you grant SHPE NJIT a non-exclusive, royalty-free, revocable license to display and use the Content solely within the Service for organizational and community purposes.

If you upload a resume or professional materials, you acknowledge that such materials may be viewable by other authorized users within the Service and that you are responsible for the accuracy and appropriateness of the information provided.

SHPE NJIT reserves the right to remove Content at any time and is not responsible for Content submitted by users.

If you believe Content violates these Terms or is objectionable, you may report it to us at njitshpe@gmail.com. We may remove Content and/or restrict accounts at our discretion.

Enforcement & Account Actions

SHPE NJIT may suspend, restrict, or terminate accounts, remove content, or limit access to features at its discretion, including for violations of these Terms, community standards, or applicable policies.

Removal of app access does not replace or override NJIT disciplinary procedures. Membership removal and formal disciplinary actions are handled through appropriate university and organizational processes.

Points, Rankings, and Recognition

Points, rankings, or recognition features are provided for engagement and community-building purposes only. They have no monetary value, do not guarantee rewards, and may be modified, reset, or discontinued at any time.

Disclaimer

Use of the Service is at your own risk. The Service is provided on an “as is” and “as available” basis.

SHPE NJIT makes no warranties, express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, SHPE NJIT, its officers, advisors, developers, and volunteers shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service or participation in events, including but not limited to loss of data, missed opportunities, or service interruptions.

Indemnification

You agree to indemnify and hold harmless SHPE NJIT and its officers, advisors, developers, and volunteers from any claims, damages, losses, or expenses arising from your misuse of the Service, violation of these Terms, violation of NJIT policies, or violation of applicable law.

Intellectual Property

The Service, including its design, logos, and software, is owned by SHPE NJIT or its licensors and is protected by applicable laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except as permitted by law.

Third-Party Links & Services

The Service may contain links to third-party websites or services. SHPE NJIT does not control and is not responsible for the content, privacy practices, or policies of third-party services.

Use of such services is at your own discretion.

Non-Discrimination

SHPE NJIT does not discriminate on the basis of race, color, national origin, sex, age, sexual orientation, veteran status, disability, or field of study, consistent with NJIT policies and applicable law.

Changes to the Service or Terms

SHPE NJIT reserves the right to modify or discontinue the Service, or to update these Terms, at any time.

Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Jersey, consistent with NJIT policies applicable to recognized student organizations.
